    Compulsory civil liability insurance for a car driver, which was initially perceived as a powerful impetus for the development of the insurance market in Russia, after 14 years turned into its opposite. Out of 200 motor insurance companies, less than 60 remain, even large and more or less stable companies rent portfolios for OSAGO. And those who remain in the market are playing ping-pong as insurers to protect themselves from mounting losses and avoid the fate of the recent market leader.

    According to the Russian Union of Insurers (RSA), in January-July 2017, the volume of accrued premiums on OSAGO amounted to 130.242 billion rubles, having decreased by 3% compared to the same period last year, and the amount of payments for the same period increased by 27% - up to 112.545 billion rubles. The number of settled cases increased by 62 thousand over the year against the backdrop of a decrease in the number of accidents, according to the traffic police.

    “According to the information we receive from the traffic police, we see a good trend that the number of accidents is decreasing. However, insurers note an increase in settled cases, which is contrary to common sense. We believe the reason is the activity of scammers in this market, who provide falsified documents on road accidents, which actually did not exist. This practice is especially common when settling cases within the framework of the European Protocol,” says Igor Yurgens, President of the All-Russian Union of Insurers and the Russian Union of Motor Insurers.

    All this suggests that the situation in the "avtograzhdanka" continues to worsen and is close to critical. The catastrophic situation in OSAGO is recognized not only by the insurers themselves, but also by the regulator, who, however, is also concerned about the availability of services in various regions of the country.

However, insurance customers or those who want to become one, unanimously complain that companies are using every opportunity to reduce their share in this market. And not only due to unwanted customers. The former market leader, Rosgosstrakh, which came under the control of the Central Bank at the end of August, managed to reduce its share in the OSAGO market from 31% to 12% in a year, from June 2016 to June 2017.

    So, what do insurance companies do so that you do not get an OSAGO policy.

    1. Imitation or organization of technical failures

    When selling e-OSAGO, insurers who are obliged to ensure the uninterrupted operation of the service still manage to organize “technical failures”. Thus, the insured is transferred to another company. As a result, he may enter into an agreement with a randomly selected insurance company or leave the insurance company's website altogether. The E-Garant system, developed by the PCA and launched in July, when, in the event of technical failures on the insurer's website, an OSAGO contract is concluded and paid through the PCA website, certainly improved the situation with the availability of policies. But there have already been complaints about the guarantee system itself.

    Sometimes it gets ridiculous when the circle closes and the system redirects a person to the same site where he originally applied. This is, of course, a clear failure of the system. It is interesting that employees of offline offices of companies - according to failed clients, very often refer to a non-working program. In fairness, it should be noted that when hundreds and thousands of clients access the PCA database at the same time, the system really fails: it was not originally designed for such a load.

    Also, a lot of complaints from insurers about non-performing payments, policies not coming to the post office, failure to enter the paid contract into the PCA database can be attributed to technical failures.

    2. Unreadable captcha

    In this case, there is no formal technical failure, the client is not transferred anywhere. He tries maniacally to guess which characters to enter, refreshes the page, tries again, misses again. And so on, until patience runs out. The most unexpected complaint on our portal was left by a client who was given a black captcha on a black background by the site.

    3. "Cunning" SMS password

    Some insurance companies manage to send such passwords to the client that it is basically impossible to enter, since they contain both Latin and Cyrillic letters. It is impossible to guess where which ones are - only by typing, sorry, selection. But the password "lifetime" to bring this fascinating process to the end, as a rule, is not enough. A variation of this “lapel” technique is that the client simply does not receive an electronic signature confirmation code.

    4. Long car check

    By law, the insurance company cannot refuse to conclude an OSAGO contract for anyone. But on the other hand, you can make sure that the client leaves and does not return. For example, to carry out a check for a period of five to 30 days. This technique is practiced, for example, in relation to new customers - we all remember that you cannot register a car without an OSAGO policy. Therefore, it is unlikely that the car owner will wait for a specific insurer for 30 days. By the same method, insurance companies dare those who previously had even minor accidents, even through no fault of their own, and sued for payments.

    5. "Changing" the price tag in the company's office

    A visitor to the Banki.ru website from Yekaterinburg did not leave a review in the People's Rating, but literally a cry from the heart: the insurance company, in which she was a client since 2014, when trying to renew the OSAGO policy, “broken” the price of 35 thousand rubles (with a calculated on the website of the PCA, the price of insurance is 8,400 rubles), explaining that "the system thinks so." (In principle, this is possible with a certain combination of increasing coefficients.) The client, of course, refused such a service and then unsuccessfully tried to issue an electronic policy for a month. “Even with tambourines go near the computer, everything will be in vain! In offices, the price tag is wound up at times. I have no idea what to do and how to issue a policy!” a reader wrote.

    6. Run out of forms

    Both paper and electronic forms can really run out, as the Russian Union of Motor Insurers issues quotas (limits) to insurance companies for paper and electronic policies, thereby controlling the number of OSAGO insurances sold. This is done so that strict reporting forms are not “lost” and do not appear later in the form of fake policies, which will have to be paid to the same PCA.

    Theoretically, a company may run out of the stated quota for the sale of e-OSAGO policies ahead of schedule and not notice this. Unfortunately, it is impossible to check whether it is really so in your case.

    7. Limited working hours of the representative / appointment for a month in advance

    This is, perhaps, one of the most common “chips” of insurance companies that do not want to give up their OSAGO license, but at the same time do not seek to recruit a new portfolio. A client from Magadan, after repeated attempts to buy e-OSAGO in Rosgosstrakh, VSK, Ingosstrakh, SOGAZ, Energogarant, Geopolis, Sterkh, AlfaStrakhovanie, finally found the office of the company, in which the forms were , and the program worked, and it was possible to issue a policy without an appointment. But it was required to appear on a weekday from 10:00 to 12:00. As the insurer from Krasnodar found out, for the money in the manager's pocket, you can agree on a time of reception that is convenient for you.

    It turned out that two working hours a day is still a humane option. Sometimes insurance company managers can even turn out to be the “elusive Joe” from the old joke - with the difference that there are still a lot of people trying to catch them. An insurer from Khabarovsk complains that the office “works at the request of employees” and is often closed “for technical reasons” - she has never managed to find living people there. Getting through to the office is also almost impossible. The client requested a call back, but no one called her back.

    8. “Where the contract was concluded, go there”

    A similar “Sberbank argument” is used by employees of offices of insurance companies when a client tries to renew an OSAGO policy in person or move from another company.

    A variation on the theme can be a direction to inspect the car at the place of registration or just where the insurer wants. “After a personal appeal to the indicated office of the company, I received an offer to present the car for inspection already ... TO TROITSK !!! What's this?! Is there a super-mega-competent center in Troitsk?!” - wrote in the "People's rating" Banki.ru insurer from Moscow. Another client, who lives in the Michurinsky district of Moscow (in the west), was sent for inspection to Ferganskaya Street (the far east of the capital). But even there he had no luck.

    “I stop by the office on Michurinsky. There they tell me in the most impudent way that since yesterday a large package of orders has come from the central office and now all domestic cars are insured only at the central office. But the office on Ferghana is not central, but an ordinary additional one. office, says the client. - They answer that who wrote SMS - gouging. Didn't think he was writing. I'm calling the hotline. They answer that they know nothing, if the central one wrote in Fergana, go there. I say that an employee of Fergana is sending to the office on Michurinsky ... They can’t answer anything. Although if there is a decision not to conduct an inspection, then it means that registration should be in any office.

    The law states that "the place of inspection of the vehicle is established by agreement of the parties." That is, you can request an inspection at the place of residence. If an agreement is not reached, then the inspection is not carried out. This is worth bearing in mind if you are also sent to ... Troitsk.

    9. "Life" with underwriting in the load

    An insured from the city of Kirzhach, Vladimir Region, specially came to the place where the previous policy was issued to extend it (see the previous paragraph). As a result, she was sent to “her” manager, who issued a policy last year, but, alas, no longer works in this office. During a telephone conversation with “her own” manager, the client found out two interesting things: she needs to arrive at a different time (from another city!) And she is obliged to purchase a life insurance policy “to load”. “The manager said that if I refuse, then she will not issue me a policy! Other employees said that if I take out a policy from another manager, my policy will go to underwriting (ridiculous!!),” writes a visitor to the Banki.ru portal.

    Most clients probably understand that in this case he does not owe anything to anyone: neither contact the same manager, nor come on a different day, much less purchase additional services from an insurance company, or, God forbid, undergo scoring or underwriting. Since the base rate varies within a rather narrow corridor, and then it is adjusted by several coefficients that cannot be interpreted in two ways. You can view the tariff corridor for your car and authorized persons on the PCA website. To refuse a client, referring to the fact that he is "bad", the insurance company has no right.

    10. No certificate from the place of work

    A user from the city of Seversk faced a completely unexpected problem: an insurance company specialist refused to renew the contract, demanding ... a certificate from the place of work. Thus, violating clause 3 of Article 15 of Federal Law No. 40-FZ “On Compulsory Insurance of Civil Liability of Vehicle Owners”, which lists the documents to be provided. A complaint filed through the website of the insurance company received a response from the head of the department with a recommendation to contact a branch of another city or draw up an agreement online.

    The first step is to check the Spam folder, the letter may be there. If the letter is not there, the car owner contacts the contact center of the insurance company. You can write an e-mail, if within a day, the answer did not come, you need to call the office of the company. Having reached the operator, it is specified what is the reason for the delay in the letter.

    Filing a complaint with the Central Bank

    Filing a complaint with the Central Bank is an effective method of putting pressure on an unscrupulous insurer. Supervision of insurance companies in the Russian Federation is carried out by the Central Bank. If there are grounds, the Central Bank of the Russian Federation obliges the insurance company to stop violating the rights of the insured.

    Before writing a complaint, carefully read the insurance contract (if available). To make a timely decision on the complaint, simple recommendations are observed:

    • In the header of the complaint, the name is obtained, the full name of the head and the contact details of the car owner.
    • In a brief form, clearly to the point, without allowing emotions, the conflict situation is described. The reasons for contacting the Central Bank of the Russian Federation, the name of the unscrupulous insurance company, its details and all the data that are available are indicated.

    It is permissible not only to send a complaint to the Central Bank in writing - you can file a complaint on the official website of the Central Bank. There is a form on the official website, if you fill it out, it is tantamount to a written appeal.

    The term of consideration is the same as with the sent letter. But when contacting through the site, the car owner does not have a copy of the document in his hands. Nothing confirms that complaints were sent to the Central Bank. But this way cannot be neglected.

    Fax

    The third way to file a complaint is to send a fax. The fax number is easy to find on the official website of the Central Bank. Reliability is the same as when contacting by e-mail. But there are disadvantages - there is no guarantee that the fax will be taken into account on the other side. And the fax has no confirmation.

    Personal appeal

    Let's say a personal visit to the reception of the Bank of Russia. But this option is acceptable if all the previous methods did not lead to a positive result. Another personal appeal is suitable for residents of the capital, it is not always possible for non-residents to visit the reception of the Central Bank the first time.

    If the filing of the complaint complies with the rules, its consideration does not take much time. And the legal rights of the insured are restored.

    Some car owners who paid and did not receive it immediately go to court. Such actions are legitimate, but first it is better to contact the Central Bank, if the situation does not change in a positive direction, then you need to go to court. Appeal to the courts involves the payment of a state fee. And the appeal to the Central Bank for citizens is free.

    Where else to turn?

    When filing a complaint with the Central Bank, it is legal to simultaneously file complaints with other organizations. It is recommended to file a complaint with the Russian Union of Motor Insurers.

    The powers of the PCA are not so significant, but the organization has the ability to influence insurance companies.

    If the insurance company sees that the car owner is taking full legal action, there are high chances that it will stop violating the legal rights of the insured.

    After the decision of our Government was adopted in the autumn of 2015, electronic insurance of motor transport and liability of car drivers came into effect. This procedure simplifies the use of insurance, it should become more accessible in all areas, the policy will be issued faster, without long registration and stay at the offices of companies. Such an electronic document does not provide for a visit by the driver to the office of the insurance company, registration will take place via the Internet. Therefore, such a document can be issued simply by being at home at the computer.

    An electronic policy has the same legal force as a paper version, but greatly simplifies its registration. To carry out car insurance, the driver needs access to the Internet. Currently, only some car owners are ready for this introduction, as some technical features are encountered. Insurers have stated that they are not yet ready for such a service.

    To date, only about 80 companies that are able to issue OSAGO policies have licenses. However, only 15 insurers provide e-insurance service. The above-mentioned Government Decree obliges all insurance companies to register electronic policies.

    How to apply for an electronic OSAGO policy

    The process of issuing a policy via the Internet is possible if there is an online mode and the necessary information about the insured car is entered. An electronic policy can be obtained after entering the company's website, the owner has the right to contact the insurer who served him earlier, or order a policy from a new company that has more favorable conditions.

    First you need to register on the website of the insurer and apply for a policy. After specifying the data and verifying them, an SMS message will be sent to the phone, which will contain a special code for accessing your personal account.

    You can enter your account if:

    • Use of password and login.
    • Choosing a product - a new insurance policy or an extension of an existing document.
    • The price of insurance depends on the age of the car and its engine power.
    • Payment for registration is carried out using a bank card.
    • Information about insurance is stored in a single system after the payment is made.

    The electronic policy is sent to the driver's e-mail after it is certified. This electronic document can be presented to traffic police officers on a smartphone.

    Advantages and disadvantages of the project

    The main advantage of electronic registration of the policy is the simplicity of the procedure and ease of use. You just need to find access to the worldwide network and enter information about the car in a special table. This service is most convenient for drivers who live far from the offices of insurance companies. An important factor was that the imposition of additional services with such a design is no longer possible. Another advantage is the convenience of saving the policy in paper or electronic form.

    But electronic registration cannot be issued when buying a new car, since when issuing an insurance policy, it is necessary to enter registration marks that are not yet on the new car. When applying for a policy, you need to be careful, errors and typos in the document become a reason to consider the policy invalid. Another disadvantage is that not all traffic police officers have devices capable of determining the authenticity of the document, so a conflict may arise at the stop.

    Problems in the application of the electronic system

    If a traffic accident occurs, then there may be misunderstandings among its participants. It will not be so easy to check how an electronic OSAGO policy is made, and how authentic the insurance document is. It is necessary to call the traffic police to the scene of the accident. Insurance companies are also finding that there is not yet a single system by which to verify the information entered by the driver. Therefore, there is a possibility that the system will be used by criminals. The government promises to quickly eliminate the existing shortcomings of the electronic data system.

    Insurance companies will regulate the exchange of information between themselves when a driver moves from one company to another. Employees of companies will save new electronic policies in a single system, and methods for verifying the authenticity of policies will also be improved. The introduction of this online insurance system will make it possible to both simplify the process of issuing policies and make the policies themselves cheaper.

    Is the OSAGO policy printed online valid?

    Insurers are advised to print out an electronic policy on paper, and certify it with the insurer with a seal, and carry such a document in the car. In general, there is no difference between this copy and the downloaded electronic policy, the information in it and its number are the same. However, in a traffic accident, the driver is not always able to turn on the phone and show the policy. The phone may become unusable, and the traffic police officer will need to find out information about the driver's insurance.

    It is almost impossible to check the policy without a document number. Theoretically, there is no need to carry a paper copy with you, as it can be faked. Back in 2015, the Government made a proposal to cancel the OSAGO policy in the printout, but so far the corresponding clause in the SDA has remained the same.

    Is the OSAGO policy valid without a diagnostic card

    Any car owner who often operates his car knows that starting from 2013, it is not necessary to carry out an inspection at the traffic police. But instead of this procedure, the state introduced another operation. When applying for an OSAGO policy, a diagnostic card for the car is now required.

    This procedure has become mandatory, but a large number of drivers are still asking: is it possible to issue a policy without a diagnostic card? This should be sorted out.

    Diagnostic card

    It confirms the fact that the car is in good condition and is issued after the technical inspection of the car. When applying for an insurance policy, this document is needed so that the client of the company can prove that his car complies with safety standards. The issuance of this card can be handled by different organizations that have a license for this. During the inspection, specialists must check the operability of the important mechanisms of the car, and the presence of safety elements - a fire extinguisher, an emergency stop sign and other elements.

    It is possible by law to issue an OSAGO policy without a car diagnostic card if the car was manufactured less than three years ago. In other cases, obtaining a policy is associated with greater risks. The diagnostic card is a certain guarantee of the safe technical condition of the car of the owner who draws up the policy.

    Any driver can issue a policy without a diagnostic card, but you need to know that such a practice may have an unpleasant effect on the violator in the future. When obtaining a policy in this way, you need to be aware of the possible risks. A driver can issue a policy without a diagnostic card in various ways:

    • Through a formal inspection at an insurance company. This is a formally clean and legal method of obtaining a policy. To carry it out, it is enough to come to the insurer that has the appropriate license for technical inspection and issuance of documents.     Before applying for a policy without a technical inspection, you should think several times what would be better - to be punished by law or to complete all the documents, spending a little time.

    Possible consequences

    It was discussed above that when applying for a policy without a technical inspection, the car owner will definitely take risks. With luck, nothing will happen, but the possible risks should be taken into account.

    The most serious consequences in this case can be:

    • Refusal to provide compensation from the insurer in case of an accident, the owner of the car will not be able to prove the serviceability of his vehicle, the technical inspection was not passed. It is easier for an insurer to pay a fine for breach of a policy than to pay for accidental damage.
    • Traffic police officers can catch you for illegally issuing a policy. In practice, such cases are rare.

    If we consider in general, then it will not be difficult to get a normal OSAGO policy without a diagnostic card. But everyone has to decide if it's worth it.     How does an electronic OSAGO policy differ from a regular one?

    The main difference between paper and electronic policies of autocitizenship is the very procedure for issuing them. The electronic method makes it possible to conclude a contract without visiting the office of the insurer, and the paper method requires visiting the office of the company.

    Outwardly, these two policy options are identical, but the paper version is printed on the company's letterhead, which is protected from forgery. The cost of car insurance in the office or online should not differ.

    If there is an Internet connection, then it is better and easier to issue an electronic policy, which eliminates the excessive imposition of services from the insurer. If you do not have the opportunity to visit the site, or there is no Internet network, then you can issue a paper version of the policy.

    The electronic version of the policy is equivalent in its legal force to the paper version and is the same official document with legal force. Their difference is also the method of registration. Information about the fact of car insurance, the insured person and the insurance company itself is stored in a single database of electronic documents.

    When will the electronic OSAGO policy be mandatory?

    The Bank of Russia has promised that in nine months CMTPL policies in electronic form will be mandatory and will solve the problem of affordability of car insurance. Insurers do not openly criticize the central bank, but imply that it is too ahead of the curve by several years. They believe that it will be inconvenient for a car owner to purchase an electronic version of the policy.

    Experts believe that insurance companies do not want such an introduction of e-insurance, since with state-controlled rates, they will not be able to charge losses due to fraud.

    The Bank of Russia officially announced that from January 1, 2017, insurance companies are required to provide electronic services for issuing policies throughout the country. This will be fixed by amendments to the laws.

    Electronic policies began to be issued in the summer of 2015, but so far their execution is only the right of the insurer, and not an obligation. Currently, there are not many insurance companies that issue policies that have the appropriate license.

    When the electronic OSAGO policy arrives after payment
